Terms & Conditions

These Terms govern your use of krytal.com (the “Website”). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website. Any services we provide are governed by a separate written agreement (see section 4).

Krytal (“we”, “us”, “our”) is a growth studio working with clients worldwide. We also build and operate Pulse, a marketing-reporting product (see section 6).

You agree to use the Website lawfully, and not to:

• use it in any way that breaches applicable laws or regulations;
• attempt to gain unauthorised access to, disrupt, or overload the Website or its infrastructure;
• scrape, copy, or republish its content except as permitted in section 5;
• misrepresent your identity or submit false information through our forms.

The Website is provided for general information. Nothing on it constitutes a binding offer, quote, or guarantee of results. Any engagement to provide services is governed by a separate written proposal, statement of work, or services agreement (an “Engagement Agreement”) that sets out scope, fees, timelines, and ownership of deliverables. Where these Terms conflict with a signed Engagement Agreement, the Engagement Agreement prevails for that engagement.

All content on the Website, including text, design, graphics, and the Krytal and Pulse names and logos, is owned by or licensed to Krytal and protected by intellectual-property laws. You may not reproduce, distribute, or create derivative works from it without our prior written permission. Ownership of any deliverables created for a client is determined by the relevant Engagement Agreement.

Pulse is our separate software product at pulse.krytal.com, governed by its own Terms of Service and Privacy Policy. These Website Terms do not govern your use of Pulse. See pulse.krytal.com/terms.

The Website may reference or link to third-party websites and platforms (such as Google, Meta, TikTok, LinkedIn, and Snapchat). We do not control and are not responsible for their content, practices, or terms. Your use of those services is subject to their own agreements.

The Website and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including as to accuracy, completeness, or fitness for a particular purpose. Any metrics, case studies, or results shown are illustrative and are not a promise or guarantee of future performance.

To the maximum extent permitted by law, Krytal shall not be liable for any indirect, incidental, special, or consequential losses, or for loss of profits, revenue, or data, arising from your use of (or inability to use) the Website. Krytal's total aggregate liability arising out of or relating to the Website or these Terms will not exceed the greater of (a) the fees you paid Krytal under the relevant Engagement Agreement in the twelve (12) months before the claim, or (b) USD 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold Krytal harmless from any claims, losses, or expenses arising from your misuse of the Website or your breach of these Terms.

• Entire agreement: these Terms, together with any Engagement Agreement and the policies they reference, are the entire agreement between you and Krytal regarding the Website.
• Severability: if any provision is held unenforceable, the remaining provisions stay in full force.
• No waiver: our failure to enforce any right or provision is not a waiver of it.
• Assignment: you may not assign these Terms without our consent; we may assign them to an affiliate or successor.
• Force majeure: neither party is liable for delays or failures caused by events beyond its reasonable control.

These Terms, and any dispute arising from them or from your use of the Website, are governed by applicable law. This does not affect any mandatory consumer-protection rights you may have in your country of residence. We will always try to resolve any concern with you directly first. Please contact us and we'll work to put it right.

We may update these Terms from time to time. Changes take effect when posted, and the “last updated” date above reflects the latest version. Your continued use of the Website after changes constitutes acceptance.
